However, please be aware that commercial use may be restricted in the following cases:

• Insufficient Rights: If you do not hold the necessary rights to the input images you uploaded or referenced.

• IP Infringement: If the generated output infringes on the intellectual property (IP) of a third party, such as copyrights or trademarks.

• Policy Violations: If the use violates ShoeCatch’s Terms of Service or the policies of our third-party AI model providers.

Note: The final decision and legal responsibility regarding the use of outputs rest entirely with the member. We strongly recommend an independent legal review for IP infringement before any commercial distribution.

Images found online are often protected by third-party intellectual property rights. Since AI can generate results similar to the provided reference, there is a risk of infringing on the original creator's rights.

As ShoeCatch gives you full control over the content you upload, please ensure you have the necessary permissions.

Pro Tip: To minimize risk, we recommend using images with secured commercial licenses from platforms like Unsplash or Pexels.

No. ShoeCatch does not use your input data or generated outputs to train AI models.

We have established Enterprise-grade agreements and Data Processing Agreements (DPAs) with our third-party AI providers. These contracts include technical safeguards to ensure your data is never used for their model training. Your data is processed strictly for the following purposes:

• Data rendering, transmission, encrypted storage, and system maintenance.

• Technical support and customer service (CS) at your request.

• Security management and detection of illegal/harmful content.

ShoeCatch claims no ownership over the outputs you generate. You retain all rights, title, and interests.

ShoeCatch is actively exploring additional IP Indemnification Insurance for our users and will provide updates as they become available.

ShoeCatch manages your data according to the following four principles:

1. Workspace Isolation: Each member’s data and outputs are managed in a logically and physically separated environment. Your data is never shown to or used by other members.

2. End-to-End Encryption: We use industry-standard encryption for both Data at Rest (storage) and Data in Transit (transmission).

3. Strict Limitations on Data Use: Data is used only for essential service operations. We never sell, lease, or share your data with third parties.

4. Breach Notification: In the event of a data breach, we will notify affected members and authorities within the legal timeframe and take immediate action to mitigate harm.

For enterprise customers, a separate Data Processing Agreement (DPA) can be arranged, allowing direct integration with the customer's dedicated storage rather than retaining data in ShoeCatch's infrastructure on a long-term basis.

For Enterprise Plan members, we offer customized data management solutions:

• Custom Storage Integration: We can integrate directly with your company's dedicated storage instead of retaining data on our infrastructure long-term.

• Custom DPA: We execute a separate Data Processing Agreement (DPA) that covers Data Residency, specific retention/deletion policies, and access audit logs.

No. Due to the nature of generative AI, ShoeCatch provides no express or implied warranties regarding the accuracy, completeness, or suitability of the outputs. We cannot guarantee that results will perfectly meet every individual requirement.

• Liability Cap: The company’s liability for direct damages is limited to the total service fees paid by the member during the 12 months preceding the incident.

• Exceptions: This limitation does not apply to damages caused by willful misconduct, gross negligence, or vmandatory provisions under applicable consumer protection laws.
